1. Acceptance of Terms
By accessing or using Figwise, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. You must be at least 13 years old to use Figwise.
2. Description of Service
Figwise provides AI-assisted tools for creating research figures, including graphical abstracts, conceptual framework diagrams, and PRISMA 2020 flow diagrams. Figures are generated from content you provide and can be edited and exported in raster (PNG) and vector (SVG) formats.
3. Fair Use and Limits
Free usage is subject to daily limits enforced per user and per IP address. Attempting to circumvent limits, scrape the service, or use it in an automated fashion without permission is prohibited.
4. Your Content and Output
- You retain all rights to the content you submit (abstracts, descriptions, data).
- Subject to these terms, you may use the figures you generate for academic and commercial purposes, including journal submission.
- You are responsible for verifying the scientific accuracy of generated figures before use. AI-generated output may contain errors; always review it as you would any draft.
- Many journals require disclosure of AI assistance. You are responsible for complying with your target journal's policies.
5. Acceptable Use
You agree not to:
- Generate content that is unlawful or infringes third-party rights
- Misrepresent research findings, including fabricating data, results, or citations
- Use the service to mass-produce figures for fraudulent, deceptive, or spammy purposes
- Attempt to reverse-engineer, scrape, or extract underlying models or algorithms
- Circumvent usage limits, rate limits, or access controls
Violation may result in warning, suspension, or termination of your account at our discretion.
6. AI Processing
Generation requests are fulfilled using third-party AI model providers. Output quality is not guaranteed; regeneration may produce different results.
7. Intellectual Property
The Figwise name, logo, website design, and software are owned by TokenMade LLC (operating as Figwise) and protected by applicable intellectual property laws. These terms do not grant you rights to our branding or software beyond normal use of the service.
8. Paid Plans and Refunds
Pricing and included usage for paid plans (subscriptions and credit packs) are stated at the time of purchase. Payments are processed by third-party providers (Stripe). Except where required by law, credits are non-transferable.
Refunds: You may request a refund within 48 hours of purchase. Refunds are subject to a processing fee charged by the payment gateway — we do not add any additional fees. To request a refund, contact support@figwise.app. For EU/EEA users: by making a purchase and beginning to use credits, you expressly consent to immediate performance and acknowledge the loss of your statutory 14-day withdrawal right.
9. Disclaimer and Limitation of Liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TokenMade LLC shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or research outcomes, arising from your use of the service.
Our total aggregate liability for any claims arising under these terms shall not exceed the greater of (a) one hundred US dollars ($100) or (b) the total amount you paid to Figwise in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless TokenMade LLC, its officers, and affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from: (a) your violation of these terms; (b) your misuse of the service; or (c) content you submit that infringes third-party rights or misrepresents research findings.
11. Changes and Termination
We may modify or discontinue features at any time. For material changes to these terms, we will provide at least 30 days' notice via email or a prominent notice on the service. Continued use after the notice period constitutes acceptance. We may suspend or terminate access for violations of these terms.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Wyoming. You agree to submit to the personal jurisdiction of such courts.
